What is No-Fault Divorce?

Before this change, one spouse had to prove wrongdoing such as adultery or unreasonable behaviour, or wait years to divorce. The new system recognises that sometimes relationships simply come to a natural end.

Under the No-Fault Divorce process:

  • Either spouse can apply for the divorce, or you can apply jointly.
  • There’s no need to prove fault or wrongdoing.
  • The language is less adversarial - terms like “decree nisi” and “decree absolute” have been replaced with “conditional order” and “final order.”

  3. Conditional Order - The court confirms there’s no reason the divorce can’t proceed.
  4. 6-week waiting period -Before the final step can be taken.
  5. Final Order - The marriage is legally ended.

The minimum timeframe is around six months, but this can vary depending on your circumstances.
