The Adoption Process in the UK

Compassionate Legal Guidance Every Step of the Way

Adopting a child is one of the most rewarding journeys you can take, but it’s also one that involves a number of legal steps, background checks, and emotional considerations.

At Lyons Bowe Solicitors, our Family Law team provides clear, compassionate, and expert legal advice throughout the entire adoption process. Whether you’re adopting as a couple, a single parent, or a same-sex family, we’re here to make the legal side as smooth and transparent as possible.

What Is Adoption?

Adoption is the legal process through which all parental rights and responsibilities for a child are permanently transferred from their birth parents to the adoptive parents. Once an Adoption Order is granted by the court, the child becomes a full and permanent member of their new family,  with the same legal rights as a birth child.

Adoption is different from fostering, which is temporary. Adoption is a lifelong legal commitment that provides a child with stability, security, and a permanent home.

Who Can Adopt in the UK?

In the UK, a wide range of people can adopt. You do not need to be married, own your own home, or have children of your own.

To adopt, you must:

  • Be aged 21 or over
  • Live in the UK or have been habitually resident here for at least 12 months
  • Pass a Disclosure and Barring Service (DBS) check
  • Demonstrate that you can provide a safe, stable, and supportive home environment

Adoption is open to single people, married couples, civil partners, unmarried partners, and same-sex couples. At Lyons Bowe, we proudly support families of all structures and backgrounds throughout the adoption process.

The Adoption Process Step by Step

The adoption process is thorough, ensuring every child is placed in the best possible home. Here’s what to expect:

1. Initial Enquiry

You’ll begin by contacting your local authority or a voluntary adoption agency. They’ll provide information sessions to explain what adoption involves and discuss your eligibility.

2. Pre-Assessment Checks

You’ll complete background checks, including DBS, health checks, and personal references. These ensure that children are placed in safe and nurturing homes.

3. Assessment and Training

This stage involves a detailed home study carried out by a social worker, along with preparation training. You’ll explore topics such as attachment, trauma, and supporting a child’s emotional needs.

4. Approval Panel

Once your assessment is complete, your application is presented to an adoption panel, which recommends whether you are suitable to adopt.

5. Matching with a Child

After approval, your agency will help find a child (or siblings) whose needs best match your family’s circumstances. This can take several months depending on the child’s age and needs.

6. Placement and Transition

Once matched, a gradual introduction period begins before the child moves into your home under a placement order.

7. The Adoption Order

After your child has lived with you for a set period (usually at least 10 weeks), you can apply to the court for an Adoption Order. Once granted, you gain full legal parental rights.

8. Post-Adoption Support

Support doesn’t end when the order is made. Many local authorities and agencies offer post-adoption services such as counselling, training, and financial support where needed.

The Role of Your Solicitor

Adoption involves legal paperwork, court applications, and sometimes complex family circumstances. Having the right legal support ensures your case progresses smoothly.

At Lyons Bowe, our Family Law solicitors can:

  • Guide you through every legal step of the adoption process
  • Prepare and submit your court applications
  • Advise on situations involving step-parent adoptions, international adoptions, or when consent from birth parents is disputed
  • Represent you at adoption hearings
  • Ensure your rights and the child’s best interests are always protected

Our role is to make the process less daunting and more understandable, so you can focus on what matters most: welcoming your child into your family.

How Long Does Adoption Take?

The process can vary, but from initial enquiry to receiving an Adoption Order typically takes 9 to 18 months. More complex cases, such as those involving overseas adoption or contested consent, may take longer.

Why Choose Lyons Bowe?

At Lyons Bowe, we combine legal expertise with genuine empathy. We understand that adoption is as much an emotional journey as it is a legal one and we’re here to support you every step of the way.

  • Specialist Family Law Team experienced in adoption, child arrangements, and parental responsibility
  • Clear communication and guidance from start to finish
  • Inclusive approach supporting families of all backgrounds
  • Fixed-fee options where possible for cost transparency

Whether you’re just starting to explore adoption or you’re ready to apply for an Adoption Order, we’re here to help.

Lyons Bowe are genuinely amazing!

Honestly I've never wanted to review solicitors before, they've been ok and have done their job at varying timescales. From the start, my partner and I have commented every single time when something happened how quick they are, and they're a delight to communicate with too! And their app is brilliant and has made things so much easier. We will use in the future and will not stop recommending.
