Prenuptial Agreements: Protecting Your Future Together

Marriage is built on love and trust, but it’s also a legal and financial partnership. More and more couples are choosing to put a prenuptial agreement (prenup) in place before they marry. At Lyons Bowe, our Family Law team advises clients across England and Wales on how prenups work, what they can include, and why they might be right for you.

Prenuptial Agreements: Protecting Your Future Together

What is a Prenuptial Agreement?

A prenuptial agreement is a contract made between two people before marriage. It sets out how assets such as property, savings, investments, and even debts will be divided if the marriage breaks down.

While prenups are not automatically legally binding in England and Wales, the courts increasingly give weight to them if:

  • Both parties entered into the agreement freely.
  • Each person had full disclosure of the other’s financial situation.
  • Independent legal advice was taken by both parties.
  • The agreement is fair and reasonable at the time of signing.

Why Consider a Prenup?

A prenup isn’t about expecting your marriage to fail it’s about planning responsibly and ensuring both partners feel secure. Common reasons couples choose a prenup include:

  • Protecting assets acquired before marriage.
  • Safeguarding family wealth, inheritance, or business interests.
  • Providing clarity in second marriages, especially where children are involved.
  • Avoiding disputes and uncertainty if separation occurs.

The Benefits of a Prenup

  1. Financial Clarity: Both partners understand how assets will be treated.
  2. Conflict Reduction: Reduces the likelihood of lengthy disputes in the event of divorce.
  3. Protection for Children: Can help ring-fence assets intended for children from previous relationships.
  4. Peace of Mind: Couples enter marriage with a shared understanding of financial matters.

When Should You Make a Prenup?

Timing is important. A prenup should ideally be signed at least 28 days before the wedding. Leaving it too late can weaken the agreement’s weight in court. The earlier discussions start, the smoother and less stressful the process will be.

Do You Need a Solicitor for a Prenup?

Yes. For a prenup to be taken seriously by the courts, both parties should receive independent legal advice. At Lyons Bowe, our Family Law solicitors will make sure your agreement is fair, clear, and tailored to your circumstances. We’ll guide you through the process, from drafting to signing, ensuring everything is handled with care.
